Condition of Equipment.

● Lesser will ensure that equipment to be handed over to Lessee will be in good condition.

● Lessee will have the opportunity to test and examine equipment before delivery. Testing is done in the rental facility of the Lesser where both parties are present.

● Lessor assumes no responsibility for the performance or non-performance of the equipment once in the care of Lessee.

● To exchange equipment, Lessee shall return to Lessor, at Lessee’s expense.

Responsibilities/Restrictions with Regard to Equipment

● Lessee shall only allow equipment to be used by duly qualified employees and/or agents.

● The Lessee shall not sublease all or any part of the equipment.

Return & Maintenance.

● If equipment is lost or returned in a damaged or destroyed condition, or if it is not returned for any reason,

● Lessee shall pay immediately to Lessor the replacement value (without deduction for depreciation) of such item.

● If equipment returns in a repairable damaged condition, Lessee shall pay to Lessor the cost of such repairs as determined by Lessor.

Rental, Late Charges.

● Lessee must return equipment on the date specified in the Rental Contract or be subject to additional charges.

● Lessee has until 5:00PM of the date specified in the agreement. However, an additional time for the return of equipment can be given once the Lessor is given 24 hours notice.

● If 24-hour notice is not given; a full additional day’s rental will be charged for any equipment not returned and additional charges will be made each day once the specified date of return has been breached.

Payment Terms.

• All rental invoices and all loss or damage invoices are payable immediately upon presentation unless other arrangements are made.

• If credit is extended to Lessee, payment must be made within 30 days after the end of the rental period.

• If payment is not made within 30 days, an interest of 2% should be added daily hereafter, and Lessee agrees to pay the same upon demand.

• Cancellation of orders are to be made 5 days prior or more to the rental date. Any cancellation made less than 5 days prior to the rental date will incur a charge of 50% of the full rental cost.
